1. INTRODUCTION

Website, you shall be deemed to have

ACCOUNT SECURITY
You are responsible for maintaining the confidentiality of the
username and password that you create during the registration
process, and you are fully responsible for all activities that occur
under your account. You agree to immediately notify TruckerCupid.com
of any unauthorized use of your username or password or any other
breach of security, and ensure that you exit from your account at
the end of each session by clicking the LOGOUT link. TruckerCupid.com WILL NOT BE LIABLE FOR ANY
LOSS OR DAMAGE ARISING FROM YOUR FAILURE TO COMPLY WITH THIS
PROVISION. You must use extra caution when accessing your
account from a public or shared computer so that others are not able
to access or record your private information. ALWAYS EXIT BY LOGGING
OUT! Otherwise you will remain logged in for several hours and if
you leave a public computer without logging out, anyone else can
access your private account.
EMAIL ADDRESSES, MAILING ADDRESS, HOME ADDRESS, PHONE NUMBERS are NOT to
be given in Members' profile comments section to the
general public viewing our site. If a member does publicly post such
information TruckerCupid.com's administrator will edit their profile comments
field to delete any type of addresses/phone numbers that were given in their
Profile comments section or in reply to a different
question not related to those items. Contact information is asked
for/required for TruckerCupid.com's private administrative member records. Personal
information should only be given by one member to another AFTER
members have met through TruckerCupid.com's Premium Member
private/secure message center within Premium Members' account
control center.
YOUR INTERACTIONS WITH OTHER MEMBERS
You are fully responsible for your interactions with other members.
You understand that TruckerCupid.com does not inquire into the background
and/or perform a background check of its members. TruckerCupid.com makes NO representations or warranties as to the
conduct of members or their compatibility with any current or future
members. TruckerCupid.com has NO liability for any damages occurring
or relating to the conduct of you or anyone else in connection with
the use of service, including without limitation, bodily injury,
emotional distress, or/and any other damages resulting from
communications or meetings with other members of this service or
people you meet through this website or websites in our network. You
agree to take precautions and responsibilities in all interactions
with other members, especially if you decide to meet offline or in
person.

kind of Content that is illegal or prohibited on the
Website. TruckerCupid.com reserves the right to
investigate and take appropriate legal action in its
sole discretion against anyone who violates this
provision, including without limitation, removing the
offending communication from the Service and terminating
the membership of such violators. It includes Content
that:
is patently offensive to the online community, such
as Content that promotes racism, bigotry, hatred or
physical harm of any kind against any group or
individual;
harasses or advocates harassment of another person;
involves the transmission of "junk mail", "chain
letters," or unsolicited mass mailing or "spamming";
promotes information that you know is false,
misleading or promotes illegal activities or conduct
that is abusive, threatening, obscene, defamatory or
libelous;
promotes an illegal or unauthorized copy of another
person’s copyrighted work, such as providing pirated
computer programs or links to them, providing
information to circumvent manufacture-installed
copy-protect devices, or providing pirated music or
links to pirated music files;
contains restricted or password only access pages,
or hidden pages or images (those not linked to or from
another accessible page);
provides material that exploits people under the age
of 18 in a sexual or violent manner, or solicits
personal information from anyone under 18;
provides instructional information about illegal
activities such as making or buying illegal weapons,
violating someone’s privacy, or providing or creating
computer viruses;
solicits passwords or personal identifying
information for commercial or unlawful purposes from
other users; and
engages in commercial activities and/or sales
without our prior written consent such as contests,
sweepstakes, barter, advertising, and pyramid schemes.

uses anyone's photo other than their own or animated
drawings, sketches, photos of animals, photos depicting
sexual acts, non-human photos, nudity, etc. and photo should be taken as
recent as in the last 12 to 24 months.

f) You may not include in your PUBLIC Member profile any
telephone numbers, street addresses, last names, URLs or

g) You may not engage in advertising to, or solicitation
of, other Members to buy or sell any products or
services through the Service. You may not transmit any
chain letters or junk email to other Members. Although
TruckerCupid.com cannot monitor the conduct of its
Members off the Website, it is also a violation of these
rules to use any information obtained from the Service
in order to harass, abuse, or harm another person, or in
order to contact, advertise to, solicit, or sell to any
Member without their prior explicit consent. In order to
protect our Members from such advertising or
solicitation, TruckerCupid.com reserves the right to
restrict the number of contacts which a Member may send to
other Members in any 24-hour period to a number which TruckerCupid.com deems appropriate in its sole
discretion.
6. Copyright Policy: You may not post, distribute, or
reproduce in any way any copyrighted material,
trademarks, or other proprietary information without
obtaining the prior written consent of the owner of such
proprietary rights. This
includes animated drawings, photos of models or persons
other than yourself.

REGISTERED PROFILE AND INDEMNITY
Member agrees that the information provided in their registration
represents his or her profile. Member's completion of the
registration steps 1 and 2 confirms their agreement to indemnify
TruckerCupid.com, its owners, and its parent entities, advertisers,
family members of same from any form of liability resulting from use
of its services. You understand that your profile will be placed on
the internet as a result of using this service and is subject to the
risks normally associated with internet data exchange. Presenting
TruckerCupid.com with any false information can
and at the discretion of TruckerCupid.com, permanent deletion of
membership data. If a paid account, there will be no refund.
TRUCKERCUPID.COM MEMBER MATCH POLICY
TruckerCupid.com does not match
members. This is a member choice based service.
RESTRICTIONS OF USE
You may use this site for purposes expressly permitted by this site.
You may not use this site for any other purpose, including any
commercial purpose, without TruckerCupid.com's express prior written
consent. For example, you may not (and may not authorize any other
party) to co brand this site or frame this site, without the express
prior written permission of an authorized representative of
TruckerCupid.com. For purposes of these Terms and Conditions of Use,
"co-branding" means to display a name, logo, trademark, or other
means of attribution or identification of any party in such a manner
as is reasonably likely to give a user the impression that such
other party has the right to display, publish, or distribute this
site or content accessible within this site. You agree to cooperate
with TruckerCupid.com in causing any unauthorized co-branding,
framing or hyper-linking immediately to cease.
DESCRIPTION AND AGE REQUIREMENT
A MEMBER MUST BE AT LEAST 18 YEARS OF AGE IN HIS/HER JURISDICTION to
use this service. An email address is used to inform the member of
their password (once a password is needed) and other member contact
requests. This service provides a private member area for the
viewing and exchanging profiles and photographs between its members,
and including members of TruckerCupid.com's other singles sites
(also referred to as "affiliate sites" or "affiliate services" or
"partner sites").
ABOUT SITES ON THIS NETWORK AND DATABASE CONTENT
Only one registration per person is allowed. All members must validate by
themselves any data or information they see about another profile in
this system.
TWO TYPES OF REGISTERED MEMBERS
There are two types of member levels in this system, the standard
(or "FREE") profile, and the upgraded/paid (PREMIUM) profile. The
standard registration is FREE and only provides a free listing in
the database but does not allow the member to send or reply to
messages to/from other
members. There are no fees charged for remaining in the system as a
standard member profile. Standard member profiles have an open
expiration, and are not removed from the system unless specifically
cancelled by either party.
DESCRIPTION OF UPGRADED PREMIUM MEMBERSHIP (does not apply until
or if TruckerCupid.com charges a fee)
Upgraded/paid members are allowed full control in the private member
area. Upgraded/paid members understand that there is a fee charged
to reach and stay at the upgraded/paid member level, and the fee
charged is an amount payable prior to the start of the period for
which the fee is intended or a repeating amount that is
automatically charged (recurring or renewed) for the term indicated.
From time to time, TruckerCupid.com. may offer special discounts or
fee structures, however such changes are not retroactive to members
already upgraded. While in upgraded/paid member status, members can
send contact emails to profiles they like, reply to other members
that contact them via the Message Center, have access to additional
profile information, replace or modify their photograph, and other
upgraded/paid member features in the member area as made available
from time to time.
ALL PAYMENTS ARE NON-REFUNDABLE
Once an account or registration is cancelled, the member loses the
right to the upgrade and must upgrade again if the account or
registration is reopened or a new one is created. ALL PAYMENTS
ALREADY MADE ARE NON-REFUNDABLE. In certain situations, refunds are
made at the discretion of the support manager. Please contact the
support team regarding refund requests. All payments are payable by
credit card or eCheck to TruckerCupid.com. An emailed receipt
will be sent to the email address you give on the payment form for
your records. Make certain you add
emailreceipts@authorize.net to your email address book or it is
highly unlikely your email server will accept such mailings. The

TERMS OF USAGE, CONTENT, AND GUARANTEE
Members agree not to use any offensive, sexually explicit, or
violent terms and verbage on this system and in use of this service,
which includes their future correspondence with any party they meet
on this service. TruckerCupid.com is not responsible for the
accuracy or nature of material or data placed onto this network by
members. Members also understand this system is not to be used for
advertising other sites or other business of any type, in any way. TruckerCupid.com reserves the right to cancel a registration at any
time without specifying a reason. TruckerCupid.com also reserves the
right to change the format and features of the service at any time
without prior notification. TruckerCupid.com does not guarantee a
specific number of successful meetings, and does not guarantee the
validity of information provided in any profile. All fees paid for
this service in connection with the subscribed membership are
non-refundable and non-transferable regardless of when a profile is
canceled or placed on hold. Members misrepresenting themselves,
signing up more once under different names, email addresses, phone
numbers, etc, will be banned and an announcement to all members will
be by TruckerCupid.com as a Fraud Alert explaining which member
committed fraud. Only ONE membership per person is allowed!
The following list is a partial list of the kind of content that is
prohibited and illegal on the website. TruckerCupid.com reserves the
right to investigate and take appropriate legal action(s) in its
discretion against any members who violate this provision, removing
the offending materials from the service and terminating the
membership of such violators without refund. Offenses such as:
harassing another member uploading such content that promotes
racism, hatred or physical harm of any kind against any group or
individual sending unsolicited or spam (including, but not limited
to sweepstakes, contests, advertising, pyramid schemes or
consecutive messages) messages to other members promoting false
information, illegal activities or conducting abusive, threatening,
obscene or defamatory activities
uploading or linking to an illegal or unauthorized copy of another
person’s copyrighted work such as pirated images, audio or video
files uploading materials that exploit persons under the age of 18
or ANY persons of ANY age, country or nationality in
a sexual or violent manner providing instructional information about
illegal activities or materials soliciting passwords or personal
information for commercial or unlawful purposes from other members. APPLICABLE
LAWS
These terms and conditions shall be governed by and construed in
accordance with the laws of the great state of Michigan,
without regard to its choice of law principles to the contrary. You
agree that any action at law or in equity arising out of or relating
to these terms and conditions shall be filed only in, and resolved
in, the federal or state courts in the City of Bay City,
Michigan and you hereby irrevocably and unconditionally consent
and submit to the exclusive jurisdiction of such courts over any
suit, action or proceeding arising out of this Notice.
AVAILABILITY OF DATABASE AND ABOUT SITE SECURITY
TruckerCupid.com does not guarantee the availability of the database
since hosting services are provided by an independent Internet
Service Provider (ISP). TruckerCupid.com provides a secure viewing
option but does not guarantee the security or privacy of information
transmitted across the Internet by email form one member to another,
nor can it guarantee the privacy of a member's profile information
when sent as a contact gesture by email as provided by the system.
The member understands that all use of a member's account is subject
to 'tapping' (or secret viewing) as is any transmission that a
professional hacker can generate, however TruckerCupid.com has never
had this to happen and takes special measures available in the IT
pool of talent to keep and maintain the highest security possible on
all private and personal data entered by us or our members. The email address and password are encrypted within each
screen of the system and TruckerCupid.com provides sessions with hidden passwords
& session
timeout capability. Member agrees to indemnify TruckerCupid.com from
all loss, financial or other, resulting from the use of its
services. Member agrees that as a member, you will be verified
as to your eligibility for membership. We take abuse of our services
very seriously!! BEWARE!
All credit card users are screened for fraud before processing to a
final state of approval by TruckerCupid.com. This is not only a
method we use to protect the innocent and ourselves from charge back
costs and losing our right to accept online payments due to a high
volume of charge backs resulting from stolen or misused credit cards
but also to learn of those who are already in a committed
relationship and should not be a member of this service. Cheaters
hurt not only TruckerCupid.com's purpose to be able to offer a
clean, safe, truthful service but cheaters cheat the entire
membership, especially those who could eventually meet and become
involved with a cheater!
INTEGRATED DATABASE
Members understand that the database they are registering with is
the TruckerCupid.com database, and is a singular (one) database used
by TruckerCupid.com members only and that once registered, their
profile can be veiwed by registered TruckerCupid.com PREMIUM members only.
NOTIFICATIONS AND ANNOUNCEMENTS
TruckerCupid.com does not sell, trade, or share your email address
or other information with any other entity. However, we do frequently
post special offers and other notifications regarding site
changes to all our members within their membership account's message
center. Collecting members' email address is used only as another
identification source that is used by TruckerCupid.com's database
system. Members will receive notices and announcements from
Administration to their membership account Message Center, NOT by
email. No emails
will be sent from Admin or other members to any other member's email
address via the TruckerCupid.com web site. Email addresses and phone numbers are
shared by premium members to other premium members of their own
choosing, privately, via the members' premium membership account's
control panel. After a member has met another member either by phone
or in person, they may share whatever information they wish.
CANCELLATION
TruckerCupid.com reserves the right to cancel a member account at
any time. Each member can cancel their account at any time by
contacting the support team or if member has an account, can go to
their account to delete their membership. Suspended accounts are retained by TruckerCupid.com for security purposes, however suspended accounts
no longer appear on the site and do not receive further
notifications of any kind.
BLOCKING OF IP ADDRESSES
In order to protect the integrity of our service, TruckerCupid.com
and its affiliates, TruckerCupid.com reserves the right at any time
in its sole discretion to block members from certain or unidentified
IP addresses from accessing the website(s). Contact us for more
details if needed. BACKGROUND CHECKS:
TruckerCupid.com does not perform background checks on our members.
AMMENDMENT OF TERMS AND CONDITIONS TRUCKERCUPID.COM RESERVES THE

UPON DOING SO WILL PLACE THE REVISED STATEMENT ON THIS PAGE. EACH

AND AFFILIATES HARMLESS FROM ALL CLAIMS, LOSSES, EXPENSES, FEES,
